Public offer for making a voluntary charitable donation This offer is addressed to an indefinite number of persons — individuals and legal entities, visitors of the website on the Internet: https://www.myhomechurchua.com/ (hereinafter — the Website), hereinafter referred to as the “Donor”, and is an official and public proposal of the RELIGIOUS ORGANIZATION RELIGIOUS COMMUNITY OF CHRISTIANS OF THE FULL GOSPEL LOCAL CHURCH “DIM” (CHRISTIAN CHURCH “DIM”), hereinafter referred to as the “CHURCH DIM”, represented by the Head of the Religious Community, DMYTRO VALERIYOVYCH NEMCHENKO, acting on the basis of the Statute, to conclude a charitable voluntary donation agreement (hereinafter — the Agreement), the subject and essential terms of which are stated below. Terms and definitions: Acceptance — full and unconditional acceptance of this Public Offer by performing the actions of transferring funds using payment forms and means placed on the Website, as well as by transferring funds to the Church’s bank account through banking institutions. The date of crediting funds to the Church’s account shall be considered the date of Acceptance. Payment — a voluntary charitable donation. Voluntary charitable donation — a monetary transfer made by the Donor to achieve the purposes, objectives, directions, and types of statutory activities of the Church in accordance with this Agreement and the Law of Ukraine “On Freedom of Conscience and Religious Organizations”. Subject of the Agreement: The subject of this Agreement is the gratuitous transfer by the Donor in favor of the Church of funds for achieving the purposes, objectives, directions, and types of statutory activities of the Church. Acceptance of the Agreement means that the Donor agrees with all its provisions, fully understands the subject of the Agreement and the purpose of collecting donations. The Agreement is concluded by the unconditional and full accession of the Donor to this Agreement and acceptance of all its essential terms. The Donor and the Church, guided by Article 207, Part 2 of Article 639, Articles 641, 642 of the Civil Code of Ukraine, and Article 18 of the Law of Ukraine “On Freedom of Conscience and Religious Organizations”, agree that the Agreement shall be deemed concluded in written form without signing a written copy by the Parties from the moment the Donor performs the actions specified in the Agreement, which indicate consent to comply with its terms. The Agreement is posted on the website https://www.myhomechurchua.com/ in open access and in a manner that ensures that any person contacting the Church can familiarize themselves with its content. The Donor cannot propose their own terms of the Agreement. Rights and obligations of the Parties: The Church has the right: 1. To receive voluntary charitable donations and use them to achieve the purposes, objectives, directions, and types of statutory activities of the Church in accordance with this Agreement and the Law of Ukraine “On Freedom of Conscience and Religious Organizations”. 2. Upon the Donor’s request, to provide a report on the received voluntary charitable donation and its use. The Donor has the right: — To transfer a voluntary charitable donation to the Church’s account in the manner specified in this Agreement; — To request a report on the use of the voluntary charitable donation. Place of fundraising: The collection of voluntary charitable donations is carried out in the territory of any country in the world. Duration of fundraising: The collection of voluntary charitable donations is ongoing unless another term is determined by the Church. Procedure for public access to the Church’s reports: Access to the Church’s reports is provided by contacting the Church’s leadership at the address specified on the website https://www.myhomechurchua.com/. Other information may be provided by the Church in the manner and within the time limits established by the legislation of Ukraine. Other conditions: All expenses related to the payment of amounts associated with the transfer of donations shall be borne by the Donor. The Donor independently determines the amount of the voluntary charitable donation. The donation is voluntary and non-refundable. The Donor is responsible for the accuracy of the information provided when making the donation. For the purpose of complying with the Law of Ukraine “On Personal Data Protection” and proper fulfillment of the terms of this Agreement, the Donor gives consent to the processing of personal data. The relations between the Donor and the Church are governed by the provisions of Ukrainian legislation.
